Job Responsibilities and Requirements: TRADEMARKS: Develop and implement strategies to protect the Companys trademarks, manage the Companys trademark portfolio, and advise on availability, validity, and enforceability Provide strategic and practical legal guidance related to domestic and international trademark legal actions and anti-counterfeiting activities PATENTS: Develop and implement strategies to protect product innovations, and advise on patentability, validity, and infringement Ensure US patent applications and foreign counterpart patent applications are prepared and timely filed Manage outside counsel, including reviewing and approving their work, related to drafting patent applications, and amendments, appeals and other responses to Office Actions COPYRIGHTS: Develop and implement strategies to protect the Companys copyrights, manage the copyright portfolio, and advise on validity and infringement Prosecute copyright applications and handle enforcement issues related to such rights GENERAL IP: Advise business partners on IP issues and interpretation of IP law Draft and negotiate trademark, patent, and copyright licenses, as well as other IP-related agreements. Develop and manage enforcement programs to identify and challenge third party activities that adversely affect the Companys brands Support merger and acquisition activity, including due diligence analysis, transaction document review, and post-closing integration of acquired companys IP portfolio Perform legal research on various issues of U.S. and international IP law Develop, coordinate, and conduct IP training for company employees and customs offices Experience and Skills Excellent understanding and extensive experience with trademark, patent, copyright, and trade secret law Ability to do IP transaction work, including IP indemnification, acquisition & divestitures, ownership and rights (including with respect to collaboration agreements), licensing and other monetization of IP rights Ability to provide legal guidance to business partners with respect to patent, trademark, copyright, and trade secret issues and matters. Experience and ability with managing outside counsel globally. Excellent communication skills, including interaction with all levels of the business and members of the law department Experience in project management and streamlining / managing processes Ability to work well with a large number of stakeholders Self-starter with an orientation towards problem solving Pragmatic, business focused approach, with an ability to balance business goals and commercial realities with legal risks Ability to demonstrate a commitment to a collegial work ethic, including mentoring and collaboration Have earned a Juris Doctor (or equivalent degree) from an accredited law school 7-10 years of professional experience managing trademark, patent, and copyright portfolios in either a law firm or in-house legal department Be a current and active member in good-standing of a U.S. state and/or federal bar association No adverse bar disciplinary proceedings or debarment action Preference will be given to candidates with experience working with apparel and/or retail companies.
