Job Responsibilities and Requirements: Responsibilities Make recommendations to the Senior Patent Attorney regarding the filing of patent applications and invention disclosures, ensuring that legal positions of the agency, inventor and contractor are clearly defined. Advise the Senior Patent Attorney of the status of assigned patent applications. Prepare draft technical decisions and advice about intellectual property issues and assist in administering the intellectual property clauses regarding contracts, grants, cooperative agreements, and Space Act Agreements.Provide preliminary review and analysis of contract clauses to ensure adequate protection of patent and data rights, making recommendations to the Senior Patent Attorney.Collaborate with the Senior Patent Counsel to educate target audiences on intellectual property issues, preserve the Government's rights in data and inventions produced with Government funding, and work with contractors regarding contract requirements as they relate to intellectual property. With oversight by the Senior Patent Attorney, recommend whether patent coverage is sufficient to allow licensing of agency inventions and negotiate license agreements.Draft legal opinions pertaining to contractual clauses or contractor's petitions for waiver of title to inventions; draft Agency determinations regarding rights of inventors. Supervisory status No Requirements Conditions of EmploymentU.S. citizenship is required Must be a member in good standing of a State bar or territory of the United States, the District of Columbia or the Commonwealth of Puerto Rico. Must be registered to practice and represent clients before the US Patent and Trademark Office (USPTO). Must meet all qualification requirements by closing date of the announcement. This is a drug-testing designated position. A financial disclosure statement is required upon appointment. The individual(s) tentatively selected for this position may be required to undergo a pre-employment background investigation. The known performance level for this position is GS-15. However, promotion is neither implied nor guaranteed. Starting salary will be set at step 1 for each grade level based on the corresponding 2017 pay table for the Cleveland area except when Highest Previous Rate applies. Occasional travel may be required. Qualifications Applicants must have at least one year of professional legal experience; or the second professional law degree (LL.M.) which requires one full year of graduate study; or the first professional law degree (LL.B or J.D.), provided the applicant's record shows superior academic achievement including but not limited to: academic standing in the upper half of the law school graduating class.When professional legal experience is used to qualify for GS-11 consideration, candidates must demonstrate they have at least one (1) year of specialized experience equivalent to the duties of a GS-09 attorney in the Federal service that has equipped them with the particular knowledge, skills and abilities to perform complex legal work, including extensive research, analysis, evaluation and/or litigation in a legal specialization relevant related to the duties and responsibilities of this position. Examples of specialized experience include but are not limited to demonstrating basic Patent Attorney skill after receiving general subject matter guidance from an experienced attorney, such as drafting simple Patent documents, Intellectual Property, or Patent Licensing related documents; researching related legal topics, writing opinions, advising clients on legal matters related to patent law, filing documents with the US Patent and Trademark Office (USPTO), and/or advocating on behalf of clients before the USPTO. Education Applicant must be a graduate from a full course of study (LL.B or J.D.) at a School of Law accredited by the American Bar Association.
