Job Responsibilities and Requirements: This role will support strategic direction and legal counsel in relation to FC laws, policies and compliance within the context of legal or regulatory requirements globally. Impact on the Business Serve as thought leader, subject matter expert and counsel for FC-related legal issues for HSBC, which includes matters that are complex and have significant potential for legal, financial and/or reputational impact for HSBC. Provide legal advice on the requirements of U.S., UK, EU, Hong, UN, and other relevant FC laws to help ensure compliance with those laws and manage HSBC s legal and reputational risks regarding Sanctions. Support efforts to appropriately manage the Group s risk of breach of FC requirements in a commercially sensitive and practical manner. Serve as a point of contact for legal advice for internal and external stakeholders with regard to FC legal risks. Develop appropriate recommendations for remediation (as needed) across businesses and regions for the Group to ensure compliance with FC legal requirements. As directed, develop strategic legal policies to ensure that the Bank s exposure to FC legal and reputational risk is managed in a commercially sensitive, practical and pro-active manner. As directed, develop and implement global standards and strategic policies (in conjunction with Financial Crimes Risk (FCR), Financial Crimes Compliance (FCC), and Financial Crimes Threat Mitigation (FCTM)) which ensure sanctions, AB&C and anti-money laundering exposure to current and emerging risks are managed appropriately. Develop and deliver training on FC legal risks across the Group as needed. Identify emerging trends in relation to FC legal requirements and develop approaches for mitigating potential legal risk. Customers / Stakeholders Ensure that management, business and FC personnel are appropriately advised of material FC legal requirements and developments and their implications. Provide legal advice and advisory support to Legal function colleagues and to the businesses and regions and to the FC global infrastructure with respect to FC laws. Provide support and guidance to global and regional control functions and businesses in the proper response to potential material violations of law, regulation and policy. Recommend selection and supervise outside counsel as appropriate. Support communication with the Global Head of FCR, FCC, FCTM, Group MLRO, the Chief Legal Officer and others, as needed, of material FC issues. Leadership & Teamwork Support clear communication of functional strategy requirements and understanding of performance management expectations Forge and maintain positive and professional working relationships with managers across global legal and risk functions and relevant business functions as well as external law firms Support the identification and dissemination of lessons learned as a result of FCC-related investigations and issues discovered Support strategies for the coordination and promotion of initiatives that result in the sharing of knowledge and best practices concerning FC legal compliance across the Group. Operational Effectiveness & Control Support leadership over issues relating to the identification, communication, and investigation of FC risks Support clear communication of functional strategy requirements and understanding of performance management expectations Exercise clear communication of proactive controls for mitigation of future legal risk Monitor the effectiveness and implementation of FC legal risk management policies and controls. Support implementation of the Group compliance policy locally by containing compliance risk in liaison with key stakeholders, supporting adequate compliance resources and training, fostering a compliance culture and optimizing relations with regulators Complete other responsibilities, as assigned Major Challenges HSBC is an extremely diverse business which operates in numerous geographies and business lines. The Group s operations take place in an increasingly regulated and complex global environment, often with significant divergence among the applicable laws and regulations of different jurisdictions. In addition, regulators are taking a far more aggressive approach in ensuring local compliance with their respective requirements and imposing increasingly stringent penalties for breaches. It is anticipated that this position will work closely with global FCC and FCTM personnel to ensure Group compliance with FC legal requirements and the Group s Global Standards. In addition, the individual in this role will work proactively with the businesses to ensure that FC legal risks are identified, mitigated, investigated, and addressed. Role Context The jobholder is required to work with considerable autonomy and expertise, dealing with significant issues across the for which there is often no clear cut solution, while still being able to provide excellent judgment and clear direction. The nature of the role requires close working contact and being considered to be a trusted advisor with senior managers across the Group, but particularly with senior managers and executives in the businesses and in Legal, Risk, FCR, FCC, FCTM, and other control functions. This role provides highly technical, professional, and, skilled legal advice. There is heightened scrutiny on all matters related to FC matters as they are a critical risk across HSBC and the financial industry, and therefore an experienced subject matter expert is required for the role. Management of Risk The jobholder will be required to advise employees on FC compliance and operational risk controls in accordance with HSBC or regulatory standards and policies; and optimize relations with regulators by addressing any potential regulatory issues.
